Mediators are members of the community who have received at least 24 hours of specialized training in conflict resolution techniques and communication skills, and are required to attend at least 8 hours of ongoing refresher trainings each year. They guide the parties through a series of steps that help them come up with a satisfactory solution. Mediators do not give advice, counsel or decide who is right or wrong.
BECOMING A VOLUNTEER MEDIATOR:
To become a mediator, you must attend MSM’s basic mediation training course (about 32 hours) and pass an interview with our Executive Director. If you are already a trained mediator, the requirement is the same. Because there are different models of mediation, we need to be assured that the volunteer mediator uses the Facilitative Model. In this model mediators are neutral, third parties who do not give advice, evaluate the case or make decisions for the parties. MSM mediators are required to read and abide by the MCH Ethics and Standards Handbook. Mediation Centers of Hawaii (MCH) is the six-center coalition of which MSM is a member.

Mediation is an effective, inexpensive way to resolve a dispute quickly. It is a voluntary and confidential process in which two or more people meet face to face to work out a mutually acceptable solution to their problem. They are assisted by a neutral third party, called a mediator.

| How Does the Process Work? |

An individual or business contacts Mediation Services of Maui, Inc.; a case manager gives basic information about the process and then gathers the necessary information to start a case file. |

After the case manager has determined that the dispute is appropriate for mediation, the mediation session is scheduled. |

During the mediation session, the mediators guide a process in which all participants have an opportunity to discuss issues and explore options for resolving the dispute. |

When the parties agree on a workable solution the mediators record the details in a written agreement. All parties sign the agreement indicating their willingness to comply with the terms. Signed copies of the agreement are given to each party. |

If an agreement cannot be reached or if one or more parties fail to comply with the terms of the agreement, Mediation Services of Maui, Inc. will help parties explore their next best option. |

The success of the mediation depends upon the cooperation of both parties to reach consensus as well as their ability to be open to new ideas. |

Mediation is the most cost effective way of settling disputes, especially when compared to using the legal system. |

Mediation Services of Maui is funded by the State of Hawaii's Center for Alternative Dispute Resolution, County of Maui, Maui United Way, Fred Baldwin Memorial Foundation, Hawaii Justice Foundation, Victoria Geist Family Foundation, National Association for Community Mediation and donors like you.
