What Is Mediation?
Mediation is an effective, inexpensive way to resolve a dispute quickly. It is a voluntary ad confidential process in which two or more people meet face to face to work out a mutually acceptable solution to their problem. They are assisted by a neutral third party, called a mediator.Who Are The Mediators?
Our mediators are trained professionals from the community who donate their services. They have extensive and specialized training in conflict resolution and communication skills. Mediators do not give advice, counsel, or decide who is right or wrong, they work with the parties to develop options, consider alternatives and come to a win-win solution.What Can Be Mediated?

What Are The Benefits Of Mediation?
Mediation is a fast and convenient way to settle a dispute outside of court.
Mediation can result in a "win/win" solution to a dispute.
Mediation is confidential. The sessions are private and any information exchanged during the process cannot be used in court. However, a signed agreement can be used in court.
Mediation allows parties to maintain control by deciding the outcome of the dispute.
Mediation is inexpensive.How Does The Mediation Process Work?
1 - An individual or business contacts Mediation Services of Maui, Inc.; a Case Manager gives basic information about the process and then gathers the necessary information to start a case file.
2 - Once the Case Manager has determined that the dispute is appropriate for mediation, the mediation session is scheduled.
3 - During the mediation session, the mediators guide a process in which all participants have an opportunity to discuss issues and explore options for resolving the dispute.
4 - If the parties agree on a workable solution the mediators record the details in a written agreement. All parties sign the agreement indicating their willingness to comply with the terms. Signed copies of the agreement are given to each party.
5 - If an agreement cannot be reached or if either participant does not comply with the terms of the agreement, Mediation Services of Maui will help parties explore their next best option.
6 - The success of the mediation depends upon the cooperation of both parties to reach consensus as well as their ability to negotiate and to be open to new ideas.How Much Does Mediation Cost?
Mediation is the most cost effective way of settling disputes, especially when compared to using the legal system.
Fees are based on annual income and range from $60 to $350 per party per session. A session can last up to 3 hours. MSM does not refuse service for inability to pay.
